Terms and Conditions

Important information about reservations, weather conditions, cancellations, safety, and liability before participating in Kami Experience classes.

Art. 1 — Identity of the Data Controller and Contact Details

Art. 2 — Scope of Application

These Terms and Conditions (T&Cs) govern the contractual relationship between Kami Experience (the School) and any individual (the Client) who books or purchases services offered by the School through the website, via WhatsApp, email, telephone, or in person. Booking any service implies full acceptance of these T&Cs in the version in effect at the time of booking. These T&Cs are drafted in Italian. In the event of conflicting language versions, the Spanish version shall prevail.

Art. 3 — Services Offered

The school offers wingfoil and kitesurfing lessons at three levels (beginner, intermediate, and advanced), wingfoil equipment rental (with or without an instructor), private individual or small group lessons, camps, and combined packages. Standard duration: wingfoil 2 hours, kitesurfing 2 hours (including briefing, equipment, water time, and debriefing). Beginner wingfoil rental: 2 hours. Intermediate/advanced wingfoil rental: 4 hours. Maximum number of students per instructor: 3 per group session. Higher levels require technical prerequisites verified by the instructor.

Art. 4 — Equipment

The School provides all necessary equipment, included in the lesson fee: wingfoil (board, foil, sail, wetsuit, boots, helmet), and kitesurf (board, kite, wetsuit, boots, helmet). Clients may use their own equipment with prior written approval from the instructor; the equipment must be suitable and in good working order. The School reserves the right to refuse the use of equipment deemed unsuitable. Clients are responsible for any damage caused to the School's equipment due to improper or negligent use. Damage from normal wear and tear is not charged to the Client.

Art. 5 — Booking and Confirmation

Reservations can be made via the TidyCal platform accessible from the website, WhatsApp at +34 643 825 387, email kamiexperience.info@gmail.com, or in person at the school's headquarters. Reservations are considered confirmed only upon written confirmation from the instructor via email or WhatsApp. The School does not guarantee availability until a confirmed reservation is made. A simple reservation request is not binding on either party.

Art. 6 — Prices, Payment and Taxation

Service prices are those listed on the website at the time of booking. Prices exclude IGIC (Canary Islands General Indirect Tax). Full payment is required upon booking confirmation. Payment methods: credit/debit card via Stripe (via TidyCal), PayPal (via TidyCal), bank transfer, Bizum, Revolut, or cash on site. The School does not store the customer's credit card details. Invoicing.

Art. 7 — Cancellation and Refund Policy

Cancellation by the Client: detailed policy with notice periods and penalties. No-shows (failure to show up without prior notice): non-refundable. Client delays: no refund. Cancellation due to weather or safety conditions: the Client is entitled to a full refund or reschedule at their discretion; notification via WhatsApp the evening before. Cancellation by the School for non-weather reasons: full refund or reschedule at the Client's discretion.

Art. 8 — Class Spots and Logistics

Spot selection is the sole responsibility of the instructor, based on wind and sea conditions, and safety requirements. Clients cannot request a specific spot. The main spots are located in Corralejo (Flag Beach) and El Cotillo, Fuerteventura. The instructor will communicate the final spot and meeting time to the client the evening before the lesson via WhatsApp. Transportation to the spot is included in the service.

Art. 9 — Participation Requirements

Minimum age: 8 years old. Swimming ability: Ability to swim independently is required. Physical and health conditions: The client is required to inform the instructor of any relevant medical conditions (heart conditions, epilepsy, orthopedic problems, pregnancy, or any other condition that may affect safety). The School treats this information as sensitive data in compliance with the GDPR.

Art. 10 — Minors

Minors under 18 may participate only upon presentation of a liability waiver form signed by their parent or legal guardian, along with a copy of their and the minor's identification documents. If authorization is granted to use images and videos of the minor, the guardian's signature is required. Without such authorization, the School will not collect or use images of the minor. The School assumes no responsibility for minors not accompanied by an adult upon arrival at the location, unless otherwise agreed in writing.

Art. 11 — Safety and Disclaimer

Kitesurfing and wingfoiling involve inherent risks: falls, bruises, muscle and skeletal injuries, contact with equipment, and adverse sea conditions. The Client knowingly participates in these risks. Before the first lesson, the Client is required to complete and sign the liability waiver form, which includes: injury waiver, personal item waiver, image/video authorization (optional), marine weather awareness declaration, acceptance of the cancellation policy, and consent to data processing. In the absence of a signed form, the School reserves the right to refuse the service without obligation to refund. The waiver does not exclude the School's liability for willful misconduct or gross negligence, nor does it exclude the consumer's mandatory rights (Royal Legislative Decree 1/2007 — TRLGDCU).

Art. 14 — Camps and Third Party Services

Camps and packages that include additional services (lodging, transfers, meals, complementary activities) are managed through third-party providers. In such cases, the School acts solely as an intermediary and not as a direct organizer. The School is not responsible for breaches, damages, or poor service attributable to third-party providers. The Client has the right to take action directly against the responsible third-party provider. When booking a camp or package with third-party services, the Client will be provided with the provider's details and the related contractual conditions.

Art. 15 — Images, Videos and Promotional Use

During lessons, photographs and videos of students may be taken and recorded by third parties appointed by the School. This material may be used for promotional purposes (website, social media profiles, marketing) only with the Client's explicit consent, expressed through the appropriate checkbox in the disclaimer form. Consent is optional and does not affect participation. The Client may withdraw consent at any time by writing to kamiexperience.info@gmail.com; the School will remove the material within 30 days. For minors, written authorization from a guardian is required.

Art. 16 — Oggetti Personali

The School is not responsible for the safekeeping of the Client's personal belongings during lessons. It is recommended not to bring valuable items not necessary for the activity. In the event of loss or theft of personal belongings, the School is not liable for damages unless proven to be intentional or grossly negligent.

Art. 17 — Processing of Personal Data

The School processes the Customer's personal data in compliance with Regulation (EU) 2016/679 (GDPR) and current Spanish legislation (LOPDGDD — Organic Law 3/2018). The methods of collection, storage, and use of personal data are described in the Privacy Policy available at kamiexperience.com/privacy-policy. The Cookie Policy is available at kamiexperience.com/cookie-policy.

Art. 18 — Online Booking, Checkout and Pre-contractual Information

The online booking service is managed through TidyCal. The customer is redirected to TidyCal to select the date and time, fill out the information, and make the payment. The final price is clearly displayed before confirmation. Payment is made via Stripe or PayPal; the School does not have access to the customer's payment information. Following payment, the customer receives an automatic confirmation email with a booking summary (course, date, time, Atlantic/Canary time zone). Acceptance of the T&Cs is mandatory to complete the booking. Separate acceptance of the Privacy Policy is required at the time of booking.

Art. 20 — Changes to the Terms and Conditions

The School reserves the right to modify these T&Cs at any time. Changes will be posted on the website, indicating the update date, and will take effect from the date of publication. Customers with active bookings at the time of the change will be notified via email. Bookings made prior to the change remain subject to the T&Cs in effect at the time of booking. Previous versions of the T&Cs are retained by the School and are available upon request.
